COVID 19 case on detained ship

The regional ministerial secretary of Health of the Bio Bio Region, Héctor Muñoz, on Sep 5, 2020, confirmed that a positive case of COVID 19 was detected aboard the 'Manantial' which was in the Bay of Concepción. The infected crew member was taken to health care, as well as six men considered to have had close contact. Meanwhile, six other crew members remaiedn aboard the vessel and awere being investigated. The ship was moored in the bay in pos. 36° 39.35' N 073° 4.08' W with 15 crew members since September 2019 and was banned from sailing due to legal disputes due to non-payment of bills.

Ship abandoned by owner since one year

The 'Manantial' with 15 crew members has been stranded in Talcahuano since a year. The Labour Directorate confirmed a lack of food, water and abandonment as they did not receive remuneration.. The ship was moored in the Bay of Concepción, in front of Talcahuano, unable to set sail due to legal problems that keep its 15 crew members on board. since July 2019 amid legal conflicts over non-payment of bills. The justice, both in Valdivia and Talcahuano, detained the ship as a guarantee that debts are paid. The crew is made up of 12 Ecuadorians, two Chileans and one Danish. The ship had unloaded corral in Valdivia, and due to weather factors, it suffered a breakdown. Given the bad weather, the company Ultramar towed itto piort. The bill was 60361 dollars. The Chilean firm accused that Mobbing Shipping did not pay that service and filed a preliminary ruling with the civil justice of Los Ríos, which decreed the national roots notified on July 27, 2019. Due to security reasons the transfer of the ship to the bay of Concepción was allowed, where it has been idled since September 12. On December 9, 2019 the Monjasa INC company asked the Second Civil Court of Talcahuano to detain the ship for the non-payment of an invoice for the ship's fuel sale contract. As a result of this situation and after having filed a protection appeal in favour of the seafarers, which was rejected by the Concepción Court of Appeals and ratified by the Supreme Court, the crew remained on the ship. The Biobío Labour Directorate attended three times to inspect the working conditions, hygiene and safety on board and found a series of irregularities. The last visit was on June 22. The crew did not have potable water, they did not have the corresponding amount of fuel to carry out the minimum tasks and pending salaries for some men since 2018.
