Bulkcarrier complied with safety requirements, but owner gets fined

The Philippine Coast Guard (PCG) has cleared of any liability the "Ming Yan" that dropped anchor in the waters of Malapascua Island off Cebu’s northern tip. The bulk carrier had complied with all safety requirements. But the vessel’s owner would have to pay a penalty for failing to file a notice of arrival, before it would be allowed to sail to its final Destination as a foreign vessel entering the Philippines is required to inform the bureaus of quarantine, immigration and customs of its arrival. The bulk carrier arrived in the Philippines on May 19 from Taipei enroute to Isabel town in Leyte to pick up cargo which did not arrive in time. The crew dropped anchor between Malapascua and Carnasa islands to await the arrival of the cargo but its presence raised suspicions among residents that the vessel was there to load the islands’ prized white sand. Barangay officials informed Bantay Dagat and police about the vessel. The police informed the Coast Guard, which inspected the ship on June 21 with representatives of the three bureaus at ist anchorage 1.3 nautical miles northwest of Tapilon Point, Daanbantayan.

Representative of three Philippine government agencies boarded the "Ming Yuan" on June 21, 2013. Immigration agents confiscated the passports and seaman's books of its 24 crew members, all of whom are Chinese. The vessel has been stranded near Malapascua Island since May 19. A Philippine Coast Guard vessel escorted the "Ming Yuan" to an anchorage area off Hagnaya. Before the vessel made a stop in Malapascua, it came from Taipei, Taiwan, and its next port is supposedly in Isabel, Leyte. According to the captain their cargo in Leyte was not yet ready and they opted to stay in Malapascua. The vessel failed to submit notice of arrival to the authorities. The owner of the vessel will also need to settle penalties with the Bureau of Immigration and the Bureau of Customs for not notifying the agencies of their presence. It took some time before the Chinese crew cooperated with authorities because it did not immediately allow the PCG personnel, accompanied by officers from the BI, BOC and the Bureau of Quarantine (BOQ), to board their ship.
