Skipper of grounded trawler sentenced

Michael Kinnaird, the captain of the "Algrie" who ran his ship agaround after drinking three pints on an empty stomach has been ordered to pay more than £5,000 on Dec 15. He was also handed a suspended prison sentence. He was breathalysed almost two hours after the incident on Oct 7, and gave a reading of 19 micrograms of alcohol per 100 ml of breath. The judge prosecuting Kinnaird said: "I’m in no doubt that his actions were affected by the alcohol in his system. The pictures are quite dramatic when you see them. That breakwater is often busy with people, fortunately there was no injury to anyone. In my view in sailing a trawler up on a breakwater there is a risk of death, both to members of the public and crew and possibly other vessels. This was undoubtedly human error.” The court heard that Kinnaird has been a skipper for the past 28 years and had spent 15-and-a-half years at sea. Kinnaird admitted failing to prevent his ship from causing serious damage to a structure and was sentenced to four months in prison suspended for two years and was ordered to pay £5,000 in the next 28 days along with a £115 victim surcharge fee.

Skipper drank on empty stomach when crashing his ship

Michael Kinnaird, 59, the captain of the "Algrie" had been drinking on an empty stomach after a bout of food poisoning when he steered the vesselinto the railings of Mount Batten Pier in Plymouth. He had alcohol in his system when breathalysed two hours after the crash - but was not over the legal limit, Plymouth Magistrates Court heard. Kinnaird, of Newlyn, Cornwall, told magistrates he had suffered food poisoning beforehand, but was quizzed on the fact he had been drinking beer. He admitted failing to prevent his ship from causing serious damage to the pier and was bailed for sentencing at Plymouth Crown Court. Kinnaird has been a skipper for 28 years, with the past 15 and a half spent at sea. The court heard that Kinnaird had missed the navigational light near the pier before crashing into it and becoming stranded. The Coastguard insisted the boat had not hit the pier, but just crashed into the rocks below. Trawler grounded off Plymouth

The "Algrie - PZ 199" ran onto rocks at the Mountbatten pier in Plymouth on Oct 7, 2017, at 9.45 p.m. The RNLI boat from Plymouth was alerted after the grounding. The Penzance-registered fishing vessel narrowly avoided the pier and was wedged so fast that it could not been freed by the lifeboat. No one was injured. A line was attached to the vessel and the Coastguard kept watch overnight. In the morning of Oct 8 the vessel managed to get free with own power and berthed in Sutton Harbour. Maritime surveyors were due to asses the extent of the damage later.
