DMW suspended license for manning agency which crewed the Eternity C

The Department of Migrant Workers has suspended the license of the manning agency and principal of the Filipino crew members of the 'Eternitiy C'. When the ship was sunk by the Houthi terrorists off the coast of Yemen, 17 out of 21Filipino seafarers remained unaccounted for. Under a DMW Department Order 1 issued in March 2024, shipowners and manning agencies wer mandated to report planned passages through the Red Sea and Gulf of Aden and ensure Filipino crew members were fully informed of the risks involved. Filipino seafarers have the right to refuse to sail in these so-called warlike zones. There were several violations noted, including failure to comply with the strict reportorial processes and other critical requirements prior to sailing. The DMW was considering other possible legal actions against the manning agency and its principal, civil and criminal remedies and verifying reports that there had been at least three fatalities aboiard the 'Eternity C', as well as statements that Houthi militants allegedly abducted several crew members of the bulk carrier. There were at least two statements that have come out, first the Houthi statement that they have 'several' crew; members and second the statement of the USA that they denounced this particular action of taking in the crew as a kidnapping action. It remained to be confirmedwhether indeed the Houthis had the rest of the crew. The DMW was working closely with Sec. Tess Lazaro and the DFA along these lines.

Government officials in the Philippines called for support to gain the release of captured crew members

Following the release of a video by the Houthis parading and interviewing crew members from the 'Eternity C' in front of cameras, government officials in the Philippines immediately called for support from other countries to gain the release of them. The Cosmoship Management, which was managing the vessel when it was attacked, also issued a statement calling on all parties to assist in the repatriation of the crewmembers held in Yemen. At the same time, the Philippines’ Department of Migrant Workers confirmed that nine of the individuals seen in the video were Filipino seafarers from the 'Eternity C'. They said, according to family members who had received calls, the men were in good health and have received medical treatment. The department said that it was working in coordination with the Department of Foreign Affairs and international partners for the safe release of the crew members. The shipping company also released a statement saying it was “deeply relieved” to see the images of the crew. It, too, said it was calling on “all parties to assist in reuniting” the crew currently in Yemen. Cosmoship Management said it will continue to work through “every available channel to support their continued care and to facilitate their safe and swift return.” The company said there were a total of 10 crewmembers and one of the vessel’s security guards, a total of 11 people, in Yemen. The Houthis, through their news channels, also confirmed they “rescued” 11 people from the sea in what they described as a two-day search and rescue operation. Their report said two individuals were injured and received medical care. In the video, a Russian electrician is in bed, with reports that he lost his leg during the attack, and one of the Filipinos was seen in bandages. The Houthis only showed 10 people, although they also said they had 11 from the ship in Yemen. The Houthi report said that they boarded the ship before it sank and found a body which was transferred to the hospital morgue. Cosmoship Management confirmed that two seafarers died during the attack. It says two others remained missing and were “now sadly feared dead.” During the video, the Houthis showed crew members saying they had been told the vessel was going to go to Eilat to load fertilizer. The Houthis then made threats against other ships that might go to Israel and used the crewmembers as a warning.

Houthis released video of captured seafarers

On July 28, the Houthi terrorists stated that they had rescued 10 seafarers from the 'Eternity C', releasing a six-minute, heavily scripted propaganda video, which was showing footage of the crew, with the Houthis claiming it as a proof that the sailors were alive and well. The video includes testimonies from the sailors stating that they were unaware of the maritime ban by the Houthis against sailing to Israeli ports. One crew member can be seen contacting home via a mobile phone, while others were depicted delivering statements. The sailors were seen thanking their captors for “treating them well” and apologizing to Palestine. Under clear duress, they stated they were supposedly en route to Eilat, a claim, which has been disputed by the ship owner. The Houthi terrorists also reiterated their threat to ships belonging to companies affiliated with Israeli ports, regardless of their destination or nationality. The 'Eternitiy C' had on board 22 crew members and three guards at the time of the attack. 10 crew members of the 'Eternity C' were rescued by a privately funded mission organised by the vessel's owner. Five crew members were assumed to be dead, and the remaining 10 were reported to have been taken by the Houthis. The United States and Human Rights Watch (HRW) have criticised the Houthis’ actions. HRW stated them to “unlawfully detaining civilians,” while US officials have accused the Houthis of “kidnapping” the missing seafarers in violation of international law.
